Welcome to Nyashu. These Terms of Use ("Terms") govern your access to and use of the Nyashu mobile application (the "App") and related services provided by Nyashu ("we," "us," or "our").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Acceptance of Terms

By creating an account or using Nyashu, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and Nyashu.

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the App or by other means. Your continued use of the App after such modifications constitutes your acceptance of the updated Terms.

2. Age Requirement

You must be at least 13 years old to use Nyashu. By using the App, you represent and warrant that you meet this age requirement.

If you are under 18 years old, you represent that you have obtained parental or guardian consent to use the App and agree to these Terms. Parents or guardians are responsible for supervising their minor children's use of the App.

We do not knowingly collect or solicit personal information from anyone under 13 years of age. If we learn that we have collected personal information from a child under 13, we will delete that information promptly.

3. Description of the Service

Nyashu is an AI-powered companion application that provides conversational experiences with AI characters named "Nyashu" and "Ayaan." The service includes:

  • Text-based chat conversations with AI companions
  • Personalized memory features that remember information you share
  • Emotional support and friendly conversation
  • A safe space for personal expression and interaction

Important Disclaimer: Nyashu is an entertainment and emotional support application. The AI companions are not real people. They are powered by artificial intelligence and language models. Nyashu is not a substitute for professional mental health services, therapy, counseling, or medical advice. If you are experiencing a mental health crisis, please contact a qualified professional or emergency services.

4. Account Registration

To use Nyashu, you must create an account using a valid email address or through Google/Apple Sign-In. You are responsible for:

  • Providing accurate and complete registration information
  • Maintaining the security of your account credentials
  • All activities that occur under your account
  • Immediately notifying us of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

5. Safety & Responsible Usage

We are committed to providing a safe and positive experience. When using Nyashu, you agree to use the App responsibly and understand that:

  • The AI companions provide emotional support but are not trained mental health professionals
  • Responses are generated by AI and may not always be accurate or appropriate
  • You should seek professional help for serious mental health concerns
  • The App is intended for personal, non-commercial use only

If you share thoughts of self-harm or crisis situations, Nyashu may provide resources for professional support. However, Nyashu is not equipped to handle emergencies. In case of emergency, please contact local emergency services or a crisis helpline immediately.

6. Content Guidelines

When using Nyashu, you agree not to:

  • Use the App for any illegal purpose or in violation of any laws
  • Attempt to manipulate, jailbreak, or circumvent the AI's safety guidelines
  • Submit content that is harmful, abusive, harassing, threatening, or hateful
  • Share explicit sexual content or attempt to generate such content
  • Impersonate others or misrepresent your identity
  • Attempt to extract, reverse-engineer, or replicate the AI's training data or models
  • Use automated scripts, bots, or other tools to access the service
  • Interfere with or disrupt the App's operation or servers
  • Share your account credentials with others
  • Use the App to promote violence, discrimination, or illegal activities

We reserve the right to moderate content and take action against users who violate these guidelines, including suspending or terminating accounts.

7. Intellectual Property

The App, including its design, code, features, AI characters, logos, and content, is owned by Nyashu and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

You may not copy, modify, distribute, sell, or create derivative works based on the App or its content without our express written permission.

The AI character names "Nyashu" and "Ayaan" and associated imagery are trademarks of Nyashu. You may not use these without authorization.

8. User Content

You retain ownership of the content you submit to Nyashu (such as chat messages). However, by using the App, you grant us a limited license to process, store, and use your content as necessary to provide the service, including:

  • Processing messages through AI models to generate responses
  • Storing conversation history for your continued use
  • Maintaining memory data to personalize your experience

We will not sell your personal conversations or use them for advertising purposes.

9. Limitations of Liability

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not warrant that the App will be uninterrupted, error-free, or completely secure.

To the maximum extent permitted by law, Nyashu and its officers, directors, employees, and agents shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, or goodwill
  • Any damages arising from your use of or inability to use the App
  • Any inaccuracies or harmful content in AI-generated responses
  • Any actions you take based on AI companion advice or responses
  • Any unauthorized access to your data due to factors beyond our reasonable control

In no event shall our total liability exceed the amount you paid us, if any, for using the App in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Nyashu and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you submit through the App

11. Termination

You may stop using the App and delete your account at any time through the Settings section of the App.

We may suspend or terminate your access to the App at our discretion, without prior notice, for any reason, including if we believe you have violated these Terms. Upon termination:

  • Your license to use the App will end immediately
  • We may delete your account and associated data
  • Provisions of these Terms that should survive termination will remain in effect

12. Dispute Resolution

If you have a dispute with Nyashu, we encourage you to first contact us at info@applotictech.com to attempt to resolve the issue informally.

Any disputes that cannot be resolved informally shall be settled through binding arbitration in accordance with the rules of the Indian Arbitration and Conciliation Act, 1996, unless you are located in a jurisdiction that does not permit arbitration agreements.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

You agree that any legal action or proceeding arising out of or related to these Terms or the App shall be brought exclusively in the courts of competent jurisdiction located in India, and you consent to the personal jurisdiction and venue of such courts.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions of these Terms remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Nyashu regarding your use of the App and supersede all prior agreements and understandings.
